These Terms of Service ("Terms") govern your use of the services provided by Follo Tracker Limited ("we", "us", or "our"), including our GPS tracking devices, mobile applications, web portal, and related services ("Services").
By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Eligibility
To use our Services, you must be:
At least 18 years old,
Able to form a binding contract,
The lawful owner or authorised user of the vehicle/device being tracked.
2. Your Responsibilities
You agree to:
Provide accurate and complete registration information,
Keep your account login details secure,
Use our Services lawfully and in accordance with these Terms,
Inform any users/drivers being tracked that their location is being monitored,
Ensure your use of GPS tracking is compliant with all relevant laws (e.g., workplace monitoring, consent).
3. Prohibited Uses
You must not:
Use the Services to track someone without their knowledge and legal consent,
Tamper with, reverse-engineer, or misuse any part of the tracking system,
Interfere with the servers or networks connected to our Services,
Use the Services to harass, stalk, or harm others.
4. Service Availability
We aim to provide reliable GPS tracking, but you acknowledge that:
Service availability may vary due to mobile network coverage, satellite reception, or system maintenance,
Data may occasionally be delayed, inaccurate, or temporarily unavailable.
We are not liable for any loss resulting from such interruptions unless required by law.
5. Payments and Fees
You agree to pay all applicable fees for your chosen service plan. All payments are due as specified in your agreement or subscription terms.
Failure to pay may result in suspension or termination of your account.
6. Intellectual Property
All content, software, and technology related to the Services are owned by Follo Tracker Limited or our licensors. You may not copy, distribute, or modify any part of our Services without our written consent.

You may cancel your account at any time by contacting us. Subscription cancellations will be subject to the terms of your plan.
9. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for any indirect, incidental, or consequential loss resulting from your use of the Services,
Our liability for direct damages is limited to the amount you paid for the Services in the last 6 months,
Nothing in these Terms excludes liability that cannot be excluded under New Zealand or Australian consumer law.

You agree to indemnify us against any claims, damages, or losses arising from your breach of these Terms or misuse of our Services.

13. Subscription Terms
When you purchase a subscription to Follo’s GPS tracking services, you agree to the following:
a. Billing and Payment
Subscription fees are billed in advance on a monthly, or annual basis (as selected during subscription).
All fees are in NZD or AUD and inclusive of GST where applicable.
You authorise us to charge your selected payment method automatically for recurring subscription fees until you cancel.
b. Renewals
Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date.
We may notify you prior to renewal.
c. Cancellations
You can cancel your subscription at any time through your account dashboard or by contacting support.
Cancellation takes effect at the end of your current billing cycle — no further charges will apply, but no partial refunds will be issued for unused time unless required by law.
d. Free Trials (If Offered)
Free trials (if offered) are available once per user and device unless otherwise stated.
At the end of the trial, your payment method will be charged unless you cancel before the trial ends.
We reserve the right to withdraw or modify trial offers at any time.
e. Refunds
Refunds are generally not provided for change of mind, partial use, or unused time.
If required under New Zealand’s Consumer Guarantees Act 1993 or Australian Consumer Law, you may be entitled to a remedy (refund, replacement, or repair) for faulty services.
f. Failed Payments
If a payment fails, we may retry the charge or suspend your account until payment is successful.
Repeated failed payments may result in cancellation of the service and deletion of stored tracking data.
g. Pricing Changes
We may update subscription fees, but will give you at least 60 days' notice before any changes take effect on your next billing cycle.
You may cancel before the new rate applies if you do not wish to continue.
